美国微信用户起诉特朗普政府（禁令害人害己）

当地时间8月21日，一美国微信用户组织“美国微信用户联盟”向加州北区的地区联邦法庭递交诉状，起诉总统特朗普签署的针对微信的行政令侵犯了宪法赋予他们的权力。

据日本媒体《日经亚洲评论》报道：

A group of WeChat users in the US is launching a legal challenge to President Donald Trump’s ban on the popular Chinese messaging app, arguing that the move violates their constitutional rights.

美国一群微信用户正向特朗普总统的禁令发起挑战，该禁令针对中国受欢迎的消息应用。用户们声称此举违背美国宪法。

8月初特朗普签署两项行政令，分别针对中国字节跳动公司的海外视频平台TikTok以及腾讯公司的社交通信软件微信设限。该禁令将在9月20日生效。这随后引发了美国微信用户的“抱团”起诉。

据彭博社22日报道：

In a complaint filed Friday in federal court in San Francisco, Chinese-American lawyers who formed the USWeChat Users Alliance claim President Donald Trump’s planned restriction on the app is unconstitutional. His Aug. 6 order bans Americans from carrying out transactions with WeChat and TikTok, another Chinese social-media platform, as of mid-September.

在向旧金山联邦法庭提起的诉讼中，成立了“美国微信用户联盟”的美籍华人律师们表示，特朗普计划中对微信的禁令是违宪的。特朗普8月6日签署的行政令禁止美国与微信和TikTok的交易。

起诉方首先认为，禁令将使美国用户失去生活中非常重要的一部分。主理律师迈克尔·比恩表示：“特朗普的禁令将使得美国微信用户失去他们在每天生活中非常重要的一部分。美国用户依靠微信沟通交流、组织社群、经营生意、发起政治参与活动。”

而在美国的宪法第一修正案中，禁止政府制定任何法律限制言论自由、媒体自由以及组织和集会自由。比恩补充说：“最高法院知道社交媒体应用软件和功能就相当于社会公共空间。它是一个可以讲话、演讲、学习、分析知识和信息的广场。”

The group argued that the app serves as a primary method to “communicate, organize social groups, run businesses and engage in political activities”, as such the ban violates the Constitution by censoring “such a fundamental part of communication”.

而禁令也将不可避免地影响到少数族裔（minority group），也即美国华人群体：

“especially when it affects an insular group that has historically been a minority that’s been subject to discrimination in the US, by law or bypractice”

“尤其是这一禁令将影响到孤立的少数族裔，他们长久以来就在法律和实际生活中受到歧视。“

除此之外，起诉方还认为，该禁令太过模糊，而法律中的不确定性本身也是违宪的。

“One of the problems with the executive order that was issued on Aug. 6 is that no one knows what it means, which has a chilling effect on users,” Bien said. “This executive order hascriminal sanctionsas possible outcomes, and no one knows what’s allowed. … The vagueness in the law is also a constitutional violation.”

“8月6日的行政令中有一个问题，没有人知道这项禁令是什么意思，这会在公众中产生寒蝉效应，”比恩说。“行政令表示（违反后）可能会处以刑事处分，但是没人知道什么样的操作是允许的。法律中这样的模糊本身也是违宪的。

彭博社记者表示，截至22日，美国司法部代表尚未回应此事。

Representatives of the USJustice Department didn’t immediately respond to an email sent after regular business hours seeking comment on the lawsuit.
